At VICTRA (“we”, “us,” or “our”), we are committed to maintaining privacy protections for our visitors (“you,” “user,” “customer,” or “consumer”). This privacy notice (“Privacy Notice”) is designed to inform you about the personal information (“Personal Information”) we collect, how we use and share it, and the choices you have about how such information is used and shared. This Privacy Notice applies to Personal Information we collect from visitors online through the VICTRA website, https://victra.com (“Site”), mobile applications (“Apps”), and from visitors through offline channels, such as interactions in our stores or phone calls (collectively, the “Platform”). This Privacy Notice may be updated from time to time. Please check this webpage on our Site periodically for further updates and changes. If we make changes, we will revise the “Last Updated” date at the top of this Privacy Notice. We encourage you to review this Privacy Notice whenever you access our Site or Apps or when you otherwise interact with us. You understand and agree that your continued use of the Platform after the “Last Updated” date means that the collection, use, and sharing of your Personal Information is subject to the updated version of this Privacy Notice. This Privacy Notice is incorporated into and subject to our Terms of Use. Unless otherwise noted, your use of our Platform constitutes your agreement to our use of your Personal Information in accordance with this Privacy Notice.
Verizon Privacy Notices.
Additional privacy notices that apply to Verizon, Fios, and other services offered by the Verizon family of companies may be viewed in Verizon’s Privacy Notice. For example, when you purchase a device from a Victra store, your Personal Information must be shared with Verizon to activate the device and provide you with services. Their privacy notices will govern their processing of your Personal Information. Victra and Verizon act as independent controllers of your Personal Information.
COLLECTION OF PERSONAL INFORMATION
As set forth below, we may collect the following Personal Information about you: 1) when you interact with us; 2) passively when you use our Platform; and 3) from third parties.
Information We Collect Directly.
We collect Personal Information that you provide when you interact with us, including, but not limited to, when you purchase a product or services, visit our store, participate in a sweepstakes or promotions, attend an event, contact us, request information, or complete a survey. This Personal Information may include, but is not limited to, your name, email address, postal address, phone number, credit card number, and other types of Personal Information. We may also collect photos, images, or video of you when you visit our stores and recordings of your voice when you call customer service. You can limit the Personal Information you provide to us, but if you choose not to provide certain requested information, you may be unable to access some of the functionality, offers, or content available on our Platform.
Store Cameras and audio recordings.
We may collect Personal Information through cameras located in and around our stores. We use this information for operational purposes such as measuring traffic patterns, tracking in-stock levels, as well as for fraud and theft prevention and security. We may also record your call to customer services for customer service management and quality control purposes. We do not use facial recognition or other biometric identification technologies to identify individuals from camera footage or images. Voice recordings made in connection with customer service calls are retained solely for quality assurance and training purposes and are not used to create biometric identifiers.
Device Data Transfer.
When you request an in-store device transfer, Victra assists you in initiating a transfer of data (such as contacts, photos, and other personal files) from your old device to your new device using cloud-based services (such as iCloud or Google) or device-to-device transfer applications (such as Samsung Smart Switch). Victra does not take custody of, copy, or retain your data during this process. The transfer occurs directly between your devices or through your personal cloud account. Victra is not responsible for any loss or corruption of data that occurs during the transfer process.
Information We Collect Passively or Automatically.
Any time you use our Platform, we may collect the following information, which may include Personal Information:
- Means used to access our Site or Apps;
- Precise location of your device or information about your approximate location each time you access our Site or Apps, in accordance with your device permissions;
- Internet Protocol (“IP”) address or other unique identifier of your computer, cell phone, or other device used to access our Site or Apps;
- Browser information and reference site domain name when you visit our Site or Apps;
- Device identifier when using our Site or Apps;
- Session data (e.g., your interactions with the Site or Apps, including products you recently viewed, shopping cart, browsing history, date and time, etc.); and
- User ID when using the Apps.
Information From Third Parties.
Social media and related services or websites. We may collect information about you through your social media services consistent with your settings on such services or from publicly available websites consistent with their terms and conditions. If you create an account or access our Site using credentials from a third-party social media platform (e.g., Facebook), we have access to certain information from that platform, such as your name, email address, friends list and public profile information, in accordance with the authorization procedures determined by that platform.
Other Third Parties. We may collect information about you from third parties that are lawfully entitled to share your Personal Information with us such as our subsidiaries, related entities and affiliates; service providers and contractors; your family and friends; our business partners; marketing and advertising companies; vendor partners; your references, etc. We may combine or link information we receive from third parties with information we have about you.
HOW WE PROCESS PERSONAL INFORMATION
We may use, disclose, and otherwise process your Personal Information we collect to:
- Communicate with you, including to fulfill or meet the reason you provided the information and respond to your comments.
- Provide and deliver products and services; process your payments, transactions and returns; for purposes related to warranties and repairs.
- Provide technical support (e.g., troubleshooting).
- Engage in advertising, promotional, and marketing activities.
- Verify or enforce compliance with the Terms of Use and policies that govern our Platform.
- Administer the Site; provide support, personalize your Site experience, analyze Site usage, and develop our Site.
- Create, maintain, customize, and secure your customer profile.
- Conduct research and development; monitor and analyze trends, usage and activities relating to the Site and its functionality, in-store activity, purchases, and experiences.
- Operate our business (e.g., financial account management, product development, and contract management).
- Prevent, detect, and investigate fraud and other suspected illegal activities; protect the rights, property, security, and safety of Victra, our Platform, our employees, customers and others.
- Investigate claims or allegations; establish, exercise or defend a legal claim; enforce our contractual rights.
- Provide ADA requested accommodation.
- Comply with legal and regulatory obligations.
- Evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us is among the assets transferred.
- Fulfill any other purpose for which you provide it.
We do not use your Personal Information for solely automated decision-making, including profiling, that produces legal or similarly significant effects concerning you without human review. If our practices in this area change, we will update this Privacy Notice and provide any additional disclosures required by applicable law.
DISCLOSURE OF PERSONAL INFORMATION
We may disclose the personal information we collect in the following situations:
- To service providers who process Personal Information on our behalf, including service providers who provide data hosting, information technology support, email hosting, marketing and analytics services, and other services for the operation of our business. We impose contractual limitations on our service providers’ use of Personal Information they collect in conjunction with providing services to us.
- To advertising, analytics, and social media platforms solely for purposes of delivering and measuring advertising on our behalf as a service provider function. Such parties are not permitted to use Personal Information obtained from us for their own independent purposes.
- To other third parties with your consent.
- To other third parties to protect our rights, defend or pursue a legal claim, or investigate or prosecute illegal activities.
- Government or judicial authorities to comply with a subpoena, court order, governmental inquiry, legal process, legal obligation, or to protect the rights, property, or safety of other users or the public.
- A successor entity or purchaser upon a merger, consolidation, or other corporate reorganization in which we participate, a sale of all or a portion of our assets, or pursuant to a financing arrangement. In this situation, we will seek assurances that the successor entity or purchaser will process personal information collected by us in accordance with this Policy.
- Data obtained from you will not be shared with any third party for their own marketing or advertising purposes.
COOKIES AND WEB TECHNOLOGIES
We use cookies and other online tracking technologies (“Cookies”) to collect information and support certain features of our websites. For example, we use Cookies to support our Platform’s features and functionality, to analyze users’ use of our Platform, and to improve our marketing efforts. How You Can Limit or Reject Cookies.
Depending on your browser or device, you may be able to limit or reject Cookies via settings on your browser or device. Please note that some functionality of our Sites may not work if you limit or reject Cookies. You can also click on the “Your Privacy Choices” link in the footer of our sites to set your cookie preferences.
BROWSER-BASED DO NOT TRACK
Some browsers incorporate a Do Not Track (“DNT”) feature. When turned on, the feature signals to websites and online services that you do not want to be tracked. We track Site users over time and across third-party websites. Because there is no universally accepted standard for responding to DNT signals, we do not currently respond to DNT signals. Some browsers and devices also support a Global Privacy Control (“GPC”) signal. We are currently evaluating our ability to honor the GPC signal as required by applicable law and will update this section upon implementation.
YOUR CHOICES AND OPT-OUT PROCEDURES
You can limit the ways we send marketing offers to you by taking the following actions:
Telemarketing: Opt-out of marketing-related calls by sending a written request to consumerprivacy@victra.com. Please note that it can take up to 30 days to remove you from existing marketing campaigns.
Emails: Opt-out of receiving marketing-related emails by following the unsubscribe instructions at the bottom of marketing emails you receive.
Text messages: Opt-out of receiving marketing-related texts by following the unsubscribe instructions included in texts you receive.
Postal mail: Opt-out of receiving marketing-related mail by sending a written request to consumerprivacy@victra.com. Note that even if you unsubscribe, you could still receive mail when we use a bulk mailing service that delivers to all homes within a ZIP code.
Please note that removal of Personal Information from our database or unsubscribing will not stop marketing or advertising content that has already been generated for distribution or is otherwise queued for transmission to you before we can implement your request. If you opt out of receiving promotional communications, we may still send you non-promotional/transactional emails or SMS, such as emails or SMS about your purchases, account verification, or as otherwise consistent with applicable law.
Location Information. The settings of your Internet browser or mobile device may allow you to stop sharing your precise location with us or others.
Emails and Click-Through URLs. Some of our email communications to you may include a click-through URL linked to a particular page on the Site. By clicking on one of these URLs, you will automatically enter our Site, and we may collect information related to the click-through. To prevent having this information collected, do not click on URL links in our email communications.
Mobile Push Notifications/Alerts. With your consent, we may send promotional and non-promotional push notifications or alerts to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device.
Google Analytics Opt-Out Browser Add On. If you want to opt-out, download and install the add-on for your web browser. The Google Analytics opt-out add-on is designed to be compatible with Chrome, Safari, Firefox and Microsoft Edge. Some of these tools are being implemented and will be available shortly. Our Site contains links to websites or resources outside of our Site for your informational purposes only. We may also provide links to third-party integrations. Third-party integrations are websites or platforms that synchronize with our Site to provide you with additional functionality, tools, or services such as maps, sending requested information, etc. You acknowledge and agree we are not responsible for the availability of third-party sites, resources, or integrations and do not endorse and are not responsible or liable for any content, advertising, goods, services, or other materials on, available through, or provided by such sites, resources, or integrations. HOW WE PROTECT PERSONAL INFORMATION
We use technical, administrative, and physical safeguards designed to help protect against unauthorized access to, use, or disclosure of information we collect or store.

As a result, while we strive to take reasonable measures to protect your Personal Information, we cannot ensure, guarantee or warrant the security of any information you transmit, and you do so at your own risk.
When we collect your Personal Information, it may be transferred to our servers in other jurisdictions, including the United States, which may not have similar data protection laws to the country in which you reside.
CHILDREN’S PRIVACY
Our Platform is not intended for children under 13 years of age. We do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on our Platform. If you believe we might have Personal Information from or about a child under 13, please contact us at consumerprivacy@victra.com. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information.
APPLICABLE LAW
This Privacy Notice is governed by the laws of North Carolina without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Privacy Notice will be exclusively with the state and federal courts of North Carolina. If any provision of this Privacy Notice is found to be invalid by a court having competent jurisdiction, the invalidity of such provision will not affect the validity of the remaining provisions of this Privacy Notice, which will remain in full force and effect.

SUPPLEMENTAL PRIVACY NOTICE FOR RESIDENTS OF CERTAIN U.S. STATES
This Supplemental Notice describes the practices of ABC Phones of North Carolina, Inc. (“we,” “our,” or “us”) regarding the collection, use, and disclosure of Personal Information about residents of California and other states that have enacted comprehensive privacy legislation that applies to us (collectively, “U.S. Privacy Law(s)”). This Supplemental Notice applies to our online and offline interactions with you, and it explains how you can exercise your privacy rights under U.S. Privacy Law. Some portions of this Supplemental Notice apply only to residents of particular states. In those instances, we have indicated that such language applies only to those residents.

A. Definitions
- “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Consumer or household. Personal Information also includes “Sensitive Personal Information” that we specifically describe in this Supplemental Notice. We only collect Sensitive Personal Information where necessary to complete transactions or comply with legal obligations and requirements.
- “Sell,” “Sale,” or “Sold” means renting, releasing, or transferring an individual’s Personal Information to a Third Party for money or other valuable consideration.
- “Share,” “Shared,” or “Sharing” means transferring an individual’s Personal Information to a Third Party for cross-context behavioral advertising or targeted advertising purposes, whether or not for money or other valuable consideration.
- “Third Party” means any non-affiliated person that is not a Vendor.
- “Vendor” means a service provider, contractor, or processor which collects, stores, or otherwise handles data for us and is bound by contractual obligations to use your Personal Information only as directed by us.

Retention of Personal Information. We retain your Personal Information for the period reasonably necessary to fulfill the purposes for which it was collected, as described in Section C, unless a longer retention period is required or permitted by applicable law. The criteria we use to determine retention periods include: (i) the length of time necessary to provide our products and services; (ii) legal or contractual obligations that require retention for a specific period; (iii) the period during which a claim or complaint could reasonably be made; and (iv) applicable statutes of limitation. When Personal Information is no longer needed, we take steps to securely delete or anonymize it.

We disclose the following categories of Personal Information to Vendors and Third Parties for a business purpose. We do not Sell or Share Personal Information of residents who are under 16 years of age. We also do not process Personal Information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects.

E. Sources from Which We Collect Personal Information
We collect Personal Information directly from you (such as your use of our Platform), as well as from joint marketing partners, public databases, providers of demographic data, professional organizations, social media platforms, and Vendors and Third Parties when they disclose Personal Information to us.
F. Data Subject Rights
Residents who reside in states with U.S. Privacy Laws have the following rights regarding our collection and use of the Personal Information, subject to certain exceptions. Please read this section carefully as some rights vary by state.
Rights that Require Verification. You may exercise the data subject rights below by contacting our Privacy Office at (855) 451-3314, consumerprivacy@victra.com or by clicking here and submitting details regarding your request. You may also authorize an agent to make data subject requests on your behalf. In such instances, authorized agents may use the same methods as you to submit the requests on your behalf. To verify your identity and protect your Personal Information, we may ask the requestor to provide information that will enable us to verify your identity in order to comply with your data subject request, such as asking your agent to provide proof of signed permission from you, or ask you to confirm with us directly that you provided the agent with permission to submit the request. In some instances, we may decline to honor your request if an exception applies under applicable law. We will respond to your request consistent with applicable law.
- Right to Know: You have the right to know the following details about our privacy practices at or before the point of collection. We have provided such information in this Supplemental Notice. You may also request that we provide you with information about the following aspects of how we have handled your Personal Information specifically in the 12 months preceding your request:
- The categories of Personal Information we have collected about you;
- The categories of sources from which we collected such Personal Information;
- The business or commercial purpose for collecting or Sharing Personal Information about you;
- The categories of Personal Information about you that we disclosed and the categories of Third Parties to whom we disclosed such Personal Information;
- The categories of Personal Information about you that we have disclosed for a business purpose and the categories of Third Parties to whom we disclosed such Personal Information;
- If we collect Sensitive Personal Information, the categories of Sensitive Personal Information to be collected, the purposes for which it is collected or used, and whether that information is disclosed; and
- The length of time we intend to retain each category of Personal Information, or if that is not possible, the criteria used to determine that period.
- Right to Deletion: You may request that we delete your Personal Information, subject to certain exceptions.
- Right to Correction: You may request that we correct any inaccurate Personal Information we maintain about you. Please note this right does not apply to Iowa and Utah residents.
- Right to Access Specific Pieces of Personal Information and Data Portability: You may ask to obtain the specific pieces of Personal Information we have collected about you in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the Personal Information to another entity without hindrance. You may not exercise this right more than two times in a calendar year.
Rights that Do Not Require Verification. You may exercise these rights through the “Your Privacy Choices” link below or at the footer of every page on our website.
- Sale of Personal Information: We do not sell your Personal Information. You therefore do not need to opt out of a sale of Personal Information by Victra.
- Sharing of Personal Information for Targeted Advertising. We do not share your Personal Information with third parties for cross-context behavioral advertising or targeted advertising purposes. You therefore do not need to opt out of such sharing by Victra.
- Right to Revoke Consent for or Limit the Use of Your Sensitive Personal Information. You also have the right to revoke consent for or limit the use of your Sensitive Personal Information to the purposes authorized by the applicable U.S. Privacy Laws.
Your Privacy Choices: This tool is being implemented and will be available shortly.
- Opt-Out Preference Signal (GPC). Some web browsers or devices allow you to pre-set a Global Privacy Control (“GPC”) signal indicating you do not want your online activity tracked or used for targeted advertising. We are evaluating our technical implementation of GPC signal recognition and will update this section when compliant. Consumers who wish to opt out of targeted advertising in the meantime may use the “Your Privacy Choices” link.
